These are the Terms of Service for Sunbrd LLC ("Sunbrd," "we," "us"). They cover our marketing site at sunbrd.com, our product Sunbrd Gifts at gifts.sunbrd.com, and any other services we offer.
By using Sunbrd or Sunbrd Gifts, you're agreeing to these terms. If you don't agree, please don't use the service.
We wrote these in plain English. Most "Terms of Service" documents are deliberately hard to read; we think that's a failure of both communication and respect. If something here is unclear, email legal@sunbrd.com.
The short version
- You can use Sunbrd Gifts to help you send gifts to people you actually know.
- We can charge for it — current pricing is on the site, and we'll tell you before any charge.
- You're responsible for the gifts you send. We're responsible for making the product work.
- Neither of us owes the other the world. Standard liability limits apply.
- We can change these terms with reasonable notice. You can cancel any time.

1. Who can use Sunbrd
You must be at least 18 years old, or the age of majority in your jurisdiction (whichever is higher), to create an account. You must provide accurate information when you sign up. You're responsible for keeping your password secure and for everything that happens under your account.
Sunbrd Gifts is currently available to users in the United States. We may expand to other regions later; we'll update these terms when we do.
2. The service
What Sunbrd Gifts does
Sunbrd Gifts helps you remember, select, and deliver gifts to people in your life. Specifically:
- You add recipients with basic information and interests
- Our AI (Claude, provided by Anthropic) suggests personalized gift cards from a catalog of major retailers
- You approve the suggestions (or modify them, or let them auto-approve after 48 hours)
- We purchase and deliver the gift card to your recipient via our fulfillment partner Tremendous
- Both you and the recipient can rate the gift
What Sunbrd Gifts doesn't do
We don't guarantee the suggestions are perfect. Gifting is an art, not a science, and our AI is a helpful assistant — not a mind reader. We promise to do our best; we don't promise every gift will be loved.
We don't manufacture, ship, or stand behind the products the gift cards are redeemable for. Those are the responsibility of the retailers your recipients shop with.
3. Payment, plans, and billing
Subscription plans
Sunbrd Gifts offers multiple subscription tiers. Current pricing is at sunbrd.com/pricing. Subscriptions are billed monthly or annually based on your selection.
Gift funding
Gift card values are funded separately from your subscription. When you approve a gift, you authorize us to charge your linked payment method for the gift card amount. We'll always show you the exact amount before you approve.
Failed payments
If we can't charge your payment method (expired card, insufficient funds, etc.), we'll pause gift delivery and email you. After 14 days of continued failure, we may suspend your account.
Refunds
- Subscription fees are non-refundable once charged, but you can cancel anytime to stop future charges.
- Gift card charges are generally non-refundable once the gift card has been delivered, since the value is already in the recipient's hands. If there's a clear problem (e.g., the gift was sent to the wrong person due to a bug), we'll make it right — email support@sunbrd.com.
Taxes
Prices do not include taxes. You're responsible for any applicable taxes on your subscription.
4. How you can (and can't) use Sunbrd
You can
- Use Sunbrd Gifts for its intended purpose: sending gifts to people you personally know.
- Add as many recipients as your plan allows.
- Cancel your account at any time.
You can't
- Send gifts to people who haven't agreed to share their information with you. If you're adding someone as a recipient, you should have their contact information legitimately (family, friends, colleagues). Don't add strangers.
- Use Sunbrd to send things other than gifts. No spam, no solicitations, no advertisements, no fraud.
- Abuse the referral or credit system. Don't create fake accounts, don't use stolen payment methods, don't try to exploit promotional credits.
- Attempt to break our systems. No reverse engineering our API, no attempting to scrape our content, no attempting to bypass security.
- Use Sunbrd if you're a sanctioned person or entity. We comply with US sanctions laws.
Violation of these restrictions may result in account suspension or termination at our discretion.
5. Your content and data
Your ownership
The data you enter into Sunbrd Gifts — recipient information, preferences, notes — remains yours. You grant us a license to use it for the purpose of operating the service (see our Privacy Policy for details on how).
Your responsibility for recipient data
When you add a recipient, you represent that you have a legitimate reason to have their information. You're responsible for ensuring that the contact information you provide for your recipients is accurate and that you have the right to use it.
If a recipient asks us to delete their information, we may do so even if you haven't requested it, to respect their preferences.
Our content
The Sunbrd brand, website design, product code, blog content, and other materials are our intellectual property. You can read and share our public content (like blog posts) for personal use with attribution. You can't copy our code, brand, or designs for commercial purposes without permission.
6. Service availability
We try hard, but we can't promise perfection
We aim for high uptime, but we don't guarantee 100% availability. Services can go down for maintenance, infrastructure issues, or circumstances beyond our control. If we have a significant outage, we'll communicate what happened.
Scheduled gift deliveries
Our system schedules gift selections approximately 15 business days before each occasion, with a 48-hour auto-approval window. This design provides buffer for delivery. However:
- If you add a recipient or occasion very close to the event date, we may not have time to process the full workflow. The system will attempt best-effort delivery but cannot guarantee same-day or next-day gifting.
- If a gift card delivery fails (e.g., invalid recipient email), we'll email you and attempt to resolve it.
7. AI-generated recommendations
Sunbrd Gifts uses Anthropic's Claude to generate personalized gift suggestions. A few things to be clear about:
- AI recommendations are suggestions, not certainties. Our AI analyzes the information you provide about a recipient and suggests gifts that fit. The quality of the suggestions depends on the quality of the information you provide.
- You're the final decision-maker. You can approve, modify, or reject any AI suggestion. The 48-hour auto-approval is a failsafe, not a default we force on you.
- We're transparent about AI use. We don't hide that our suggestions are AI-generated. You know, and your recipients don't need to unless you tell them.
- AI will occasionally make mistakes. We aim to reduce these over time through the feedback loop (your ratings improve future suggestions), but we don't guarantee every AI suggestion will be appropriate.
8. Disclaimers
The service is provided "as is" without warranties of any kind, express or implied. We don't warrant that:
- The service will be uninterrupted or error-free
- Every AI-generated suggestion will be appropriate
- The service will meet your specific requirements
- Any information obtained through the service is accurate or reliable
To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law:
- We're not liable for indirect, incidental, or consequential damages. This includes lost profits, lost goodwill, or damages resulting from how a gift was received.
- Our total liability is capped at the greater of $100 or the amount you paid us in the 12 months before the claim arose.
- We're not responsible for the products gift cards are redeemed for. The retailers that accept our gift cards are third parties; their products are their responsibility, not ours.
Some jurisdictions don't allow the exclusion of certain damages, so these limitations may not apply to you in full.
10. Changes to these terms
We may update these terms from time to time. When we make material changes, we'll:
- Update the "Last updated" date at the top of this page
- Email active users with a summary of the changes
- Post a notice on the site for at least 30 days before the changes take effect
If you disagree with changes, you can cancel your account. Continued use after changes take effect constitutes acceptance.
11. Termination
You can cancel anytime
You can cancel your Sunbrd Gifts subscription at any time from your account settings. Your access continues until the end of your current billing period. You can delete your account entirely by emailing privacy@sunbrd.com.
We can terminate accounts
We may suspend or terminate accounts that:
- Violate these terms
- Engage in fraud, abuse, or illegal activity
- Fail to pay for an extended period
If we terminate your account for cause, we'll tell you why (unless legal or security reasons prevent us from doing so).
12. Governing law and disputes
These terms are governed by the laws of the State of Connecticut, without regard to conflict of law principles.
If we have a dispute, let's try to resolve it directly first. Email legal@sunbrd.com. We'll respond within 30 days and try to work things out.
If we can't resolve it informally, any dispute will be handled in the state or federal courts located in Connecticut. You and Sunbrd consent to the exclusive jurisdiction of those courts.
13. General provisions
- Severability. If any part of these terms is found unenforceable, the rest remains in effect.
- No waiver. If we don't enforce a provision, that's not a waiver of our right to enforce it later.
- Assignment. You can't transfer your account or these rights without our permission. We may transfer our rights in connection with a business sale or transfer.
- Entire agreement. These terms, together with our Privacy Policy, are the complete agreement between you and Sunbrd regarding the service.
